US President, Donald Trump has issued a new executive order on 14th August 2020 that extends TikTok owners, Bytedance’s time to move its operations out of the US. The new order gives ByteDance 90 days instead of 45 days to either sell or spin-off its TikTok operations in the US.

There is credible evidence that leads me to believe that ByteDance Ltd., an exempted company with limited liability incorporated under the laws of the Cayman Islands (“ByteDance”), through acquiring all interests in musical.ly, an exempted company with limited liability incorporated under the laws of the Cayman Islands (“Musical.ly”), might take action that threatens to impair the national security of the United States,” Trump wrote in the executive order.

The Trump administration has many times accused ByteDance of committing espionage on behalf of China. President Trump says the company is storing information on US citizens and allowing the Chinese government to access it. ByteDance has denied this accussation several times.

Originally, TikTok had a deadline to leave the US on 20th September 2020; with the new order, that time has been extended until 12th November 2020.

The new executive order requires ByteDance to destroy any TikTok data from US users. It also has to report to the Committee on Foreign Investment once all the data has been destroyed. ByteDance is also required to destroy any data collected from TikTok’s predecessor Musical.ly. ByteDance bought Musical.y in 2017. The first executive order that had the 45-day deadline didn’t include these requirements.

Microsoft is in the running to acquire TikTok operations in the US and has said it will wrap it up by 15th September 2020. Twitter is also reportedly in the mix. Microsoft co-founder Bill Gates, however, believes that a deal with TikTok will cause problems for Microsoft. The billionaire says that any potential deal for the viral video app will be difficult.
