Tesla has filed a lawsuit against California’s Alameda County in U.S. District Court for California’s Northern District, over its policy on business closures. CEO, Elon Musk had earlier threatened to carry out this legal action via a tweet.
The electric automaker says that the county rules are contradictory to state policy on business closures. The company is seeking a permanent injunction that would prevent the enforcement of Alameda county orders.
It wants the court to declare that the county’s orders violate the Fourteenth Amendment and go against an order from the State of California.
This is after, Governor Gavin Newsom had said that businesses in 16 industries could remain active. Meanwhile, the county had refused to allow some industries, including Tesla, to resume their normal activities.
Newsom’s office had planned a “four-stage framework to allow Californians to gradually reopen some lower-risk businesses and public spaces” in a statement.

The statement says, “counties can choose to continue more restrictive measures in place based on their local conditions, and the state expects some counties to keep their more robust stay at home orders in place beyond May 8.”
An Alameda County spokesperson told The Verge that the County’s Health Care Services Agency and Public Health Department have been “communicating directly and working closely with the Tesla team on the ground in Fremont. This has been a collaborative, good-faith effort to develop and implement a safety plan that allows for reopening while protecting the health and well-being of the thousands of employees who travel to and from work at Tesla’s factory.”
Tesla made plans to resume operations in the county with the intention of bringing back 30% of its workforce. However, the County’s policy is causing a delay in those plans.
