New Mexico Sue Google For Illegally Collecting School Children’s Data

The US state of New Mexico is suing Google for illegally collecting the personal data of school children.

 

Google is alleged to have gathered data on which websites pupils visited, passwords, videos watched, contact lists, amongst other information.

 

The lawsuit also alleges that Google collected the information from its Google’s Chromebook laptops and G Suite for Education programme.

 

“The consequences of Google’s tracking cannot be overstated: Children are being monitored by one of the largest data mining companies in the world, at school, at home, on mobile devices, without their knowledge and without the permission of their parents,” the lawsuit said.

 

A Google spokesman, Jose Castaneda, labels the claims as “factually wrong”.

 

“G Suite for Education allows schools to control account access and requires that schools obtain parental consent when necessary. We do not use personal information from users in primary and secondary schools to target ads,” he said.

Google Chromebooks and G Suite for Education are free for more than 60% of students in New Mexico, according to the lawsuit.

Tracking student data without parental consent is illegal and dangerous

Attorney General Hector Balderas alleges that Google failed in getting any parental consent from children under 13 before collecting their data for commercial purposes. This is in violation of the Children’s Online Privacy Protection Act.

 

“Student safety should be the number one priority of any company providing services to our children, particularly in schools. Tracking student data without parental consent is not only illegal, [but it is also] dangerous,” Mr Balderas said in a statement.

 

“Google should be telling parents that they’re going to stalk and track these children, and under the guise of education,” he added, in a statement to KRQU News in Albuquerque.

 

Google says its “core” products for schools, comply with privacy regulations. The regulations require companies to use students’ data only for school purposes. The company denies that its core education products collect student data for the purpose of targeted ads.
